Profile - Penelope Pengilley

Penelope Pengilley has had a distinguished career with over 25 years' experience as a senior commercial litigator in Australia. She has practiced in house as general counsel for a government department and held partner positions at prominent law firms before joining Brian Ward & Partners as a Director.

Penny has extensive experience in contracts, trusts, directors’ duties, competition & consumer protection, copyright, professional negligence, insurance, shareholders’ disputes and Corporations Act matters.

Penny is well recognised for her work in corporate reconstruction and insolvency advising directors, insolvency practitioners, creditors, landlords, customers and other stakeholders in distressed companies. Working in this sector, she has a commitment to alternative dispute resolution and achieving practical commercial results within a reasonable time frame.

She has a strong interest in husbanding limited litigation resources and developing innovative and cost effective ways of preparing cases for trial. Penny's career achievements include acting in:

  • an equitable priority dispute involving issues of breaches of directors duties, notice, inducing breach of contract and the back dating of documents;
  • a case involving the set off provisions in the Corporations Act;
  • the Opes Prime test case issues including the terms of a margin lending facility, equitable interest and notice; and
  • a copyright case concerning whether copyright exists in respect to computer generated documents and the extent of implied licenses.

Penny has assisted clients in managing potential exposures to a variety of claims in a number of industries and is consulted to resolve difficult commercial issues.

Penny is a published author and regular speaker. She has published articles in both Victorian and National newspapers and professional journals.
