Profile - Jane Kupsch
Jane Kupsch is accredited under the Law Institute of Victoria’s Specialisation Scheme as an Accredited Commercial Litigation Specialist. Jane’s experience spans a broad range of litigation and alternative dispute resolution across various state and federal courts and tribunals. Jane also provides legal advice in general commercial matters to a range of private and not-for-profit organisations.
Jane’s experience includes:
- litigation under the Trade Practices Act 1974 (Cth), contractual litigation, equitable claims including breach of trust and breach of confidence, the enforcement of restraint of trade clauses, infringement and protection of intellectual property rights, personal injury claims, debt collection, employment law, directors’ duties and claims relating to the operation of insurance policies and
- applications for urgent injunctive relief;
- providing risk management and compliance advice;
- advising the producers of a national live-to-air television program about its statutory obligations, defamation risk, privacy issues, talent contracting and insurance requirements;
- advising various entities about employment issues, including the drafting of employment contracts and the provision of advice regarding the statutory and contractual obligations of employers and employees;
- advising in relation to the interpretation and application of insurance policies and the making of claims;
- insolvency and debt collection, including enforcement, winding-up and bankruptcy proceedings;
- advising local government authorities in relation to various matters including statutory interpretation and compliance;
- acting in the sale of businesses including the provision of due diligence services and the identification of litigation risk.
