The subject of contingency fees has again been the subject of media commentary in response to the Productivity Commission's draft recommendation that they be permitted subject to strict oversight. Director, Penelope Pengilley, suggests that  a requirement for security for costs  should also be brought into the mix so as to manage the potential risk to defendants that unsuccessful plaintiffs cannot meet adverse costs orders.
